The federal appeals court has maintained a prohibition on sending national guard in Portland, Oregon, after a latest court ruling.

Judicial Panel Concurs to Reconsider Case

The federal appeals court ruled on Tuesday that it would rehear the case concerning the executive power with an expanded group of eleven justices. The court also overturned a earlier decision from a three-judge panel that had sided with the federal government.

Legal Saga Over Troop Deployment

This order represents the latest development in a long-running court case over whether the administration has the authority and justification to deploy national guard forces in the city. Approximately 200 federalized guard members have been in uncertainty since the end of September when the mobilization attempt was started in due to ongoing demonstrations.

Conflicting Arguments

The federal government has argued that federal officials at the immigration center in the southern part of the city were facing threats, while city and state officials maintain that local officers have command of the circumstances.

Contrary to characterizations of Portland as a conflict zone, residents have been posting footage of scenic paths and a vibrant culinary culture, and organizing activities such as an protest bicycle event against the “militarization of our city”.

Recent Legal Actions

The Tuesday ruling came after a federal judge in Portland issued two legal injunctions this month – one blocking the federalization of the state troops, and another prohibiting the deployment of any military personnel in Oregon, after efforts to circumvent the first order by calling up out-of-state forces.

On Monday, the appeals court had put the first ruling on hold – allowing command of state troops – but the subsequent injunction stayed effective, blocking the actual deployment of the troops.

En Banc Review

The latest ruling means the matter will be heard “en banc” – with both rulings under consideration together – by a panel of 11 judges.

“This ruling shows that the truth matters and that the judicial system are striving to ensure government responsibility. The constitution restricts the executive authority, and local populations cannot be treated as a training ground for expansive government power,” said the legal representative in a official comment.

“The judicial body is sending a definite signal: the president cannot send the military into US cities unnecessarily. We will continue protecting state legislation, principles, and sovereignty as this case moves forward and our legal battle continues in the courts.”
